MadeBy Shops Seller Policy

Welcome to MadeBy Shops, a multi-vendor marketplace dedicated to handmade and handcrafted goods. This Seller Policy outlines the requirements, responsibilities, and guidelines for sellers using our platform. By registering as a seller on MadeBy Shops, you agree to comply with this policy and all related terms and conditions.

Seller Eligibility:

  • Small Business Requirement: Sellers must be small businesses with no more than 5 employees.

  • Product Categories: Items sold must fall into one of the following categories:

    • Handmade: Products that are created and assembled by the seller’s own hands.

    • Handcrafted: Products that are crafted using traditional methods and tools, with significant input and oversight by the seller.

    • Small Machine Crafted: Products created using small-scale machines such as laser engravers, heat presses, or small CNC machines, where the seller has substantial involvement in the design and production process.

Prohibited Practices:

  • Mass Production: Sellers are prohibited from mass producing items in a factory-like manner. Each item must reflect the craftsmanship and personal touch of the seller.

  • Replicas and Infringement: Sellers must not replicate, copy, or infringe upon the designs, trademarks, or copyrights of others. All products must be original or have the proper permissions for use.

  • Illegal Activities: Engaging in illegal activities, including but not limited to selling counterfeit goods or engaging in fraud, is strictly prohibited.

Content Ownership and Licensing:

  • Ownership: Sellers retain ownership of the content they upload, including listings, descriptions, images, and other materials.

  • License: By uploading content to MadeBy Shops, sellers grant the platform a non-exclusive, royalty-free license to use, modify, reproduce, and distribute their content for the purpose of operating and promoting the platform.

Product Listings:

  • Accuracy: Sellers must ensure that their product listings are accurate and complete, providing clear descriptions and high-quality images.

  • Compliance: All products must comply with MadeBy Shops' guidelines and policies, as well as any applicable laws and regulations.

  • Intellectual Property: Sellers must obtain the necessary permissions from copyright or trademark owners when using images, phrases, or producing replicas.

Tier Membership Payments:

  • Payment Structure:

    • Sellers will be billed for their selected tier membership on the 30th after they sign up. Subsequent payments will be automatically billed after first initial payment.

  • Membership Changes:

    • Sellers have the flexibility to change their membership tier at any time. Changes to a higher or lower tier will take effect immediately, and the billing cycle will adjust accordingly.

  • Cancellation Policy:

    • Sellers cannot cancel their membership directly through the platform. To cancel a membership, sellers must contact MadeBy Shops at vendorhelp@madebyshops.com with their cancellation request.

    • Cancellations will be processed within 5 business days, and access to seller features will be terminated at the end of the current billing cycle.

  • Refunds:

    • Membership fees are non-refundable. Sellers are encouraged to review their tier selection carefully before committing to a membership.

  • Failed Payments and Late Payments:

    • If a payment fails, sellers will be notified via email and must update their payment information within 5 days to avoid suspension of their seller account.

    • If payment is not made within this period, the seller's shop page will be suspended until the outstanding payment is received.

  • Automatic Renewals:

    • Memberships will renew automatically unless a cancellation request is received and processed prior to the renewal date.

Communication and Customer Service:

  • Timeliness: Sellers must respond to buyer inquiries within 24 hours. Sellers must also communicate order fulfillment and shipping confirmation to purchaser within 24 hours of shipping product. If there is an issue please email vendorhelp@madebyshops.com

  • Returns and Refunds: Sellers must handle returns and refunds in accordance with the following:

    • Purchasers must request a refund within 48 hours of receiving the item.

    • Sellers must process the refund or exchange within 7 days of receiving the request.

    • Items must be returned in the exact condition they were received.

    • Purchasers must submit pictures of the item when requesting a refund.

    • Sellers will determine who pays for shipping costs.

Dispute Resolution:

  • Initial Resolution: If a dispute arises, sellers and purchasers should attempt to resolve it directly.

  • Escalation: If an agreement cannot be reached within 48 hours of the return request, the purchaser may escalate the issue to MadeBy Shops' admin.

  • Admin Mediation: Admin will review all communication, purchaser's pictures, and any pertinent documentation before making a decision.

  • Compliance: If the admin decides in favor of the purchaser, the seller has 48 hours to comply with the return decision.

Monitoring and Compliance:

  • Dashboard Monitoring: Seller compliance will be monitored through the Marketplace Dashboard.

  • Warnings and Removal: Sellers who repeatedly engage in disputes, provide insufficient product listings, or fail to adhere to marketplace policies will receive an initial warning. Further violations may result in removal from the marketplace without refund.

Liability and Indemnification:

  • Seller Responsibility: Sellers are responsible for obtaining permissions for any copyrighted or trademarked materials used and for any legal issues that arise from their listings.

  • Platform Liability: MadeBy Shops and its owners are not liable for any loss of income or products due to seller violations, disputes, or account bans.

  • Legal Compliance: Sellers agree to indemnify and hold harmless MadeBy Shops and its owners from any claims, damages, liabilities, costs, or expenses arising out of their use of the platform or violation of any terms.

Changes to Seller Policy:

  • MadeBy Shops reserves the right to update or modify this Seller Policy at any time. Changes will be effective immediately upon posting on the platform. Sellers are responsible for reviewing the policy periodically to stay informed of any updates.
