User Rights and Responsibilities:

When using MadeBy Shops, users have the right to browse listings, make purchases, and communicate with sellers. However, users also have the responsibility to abide by our website's rules and policies, as well as any applicable laws and regulations. This includes not engaging in prohibited activities, respecting the intellectual property rights of others, and maintaining the confidentiality of their account information.

Users of MadeBy Shops are prohibited from engaging in the following activities while using our platform:

  4. Violation of Policies: Users may not violate any of the platform's policies or guidelines, including those related to content, listings, or user conduct.

  5. Unauthorized Access: Users may not access or attempt to access accounts, data, or information belonging to other users without authorization.

  6. Fraudulent Activity: Users may not engage in any fraudulent activity, such as misrepresenting products or services, or engaging in deceptive practices.

  7. Intellectual Property Infringement: Users may not infringe on the intellectual property rights of others, including copyrights, trademarks, and patents.

  8. Spamming: Users may not send unsolicited or unauthorized communications, advertisements, or promotions to other users.

  9. Violation of Laws: Users must comply with all applicable laws and regulations while using our platform.

 

Content Ownership and Licensing:

All content uploaded or shared by users on MadeBy Shops, including listings, descriptions, images, and other materials, is owned by the respective sellers and the platform. By uploading content to MadeBy Shops, sellers grant the platform a non-exclusive, royalty-free license to use, modify, reproduce, and distribute their content solely for the purpose of operating and promoting the platform. MadeBy Shops is committed to protecting the intellectual property rights of sellers and third parties.

Disclaimers of Liability:

  1. Accuracy of Information: MadeBy Shops strives to provide accurate and up-to-date information on the website. However, we do not warrant the accuracy, completeness, or reliability of any content, information, or materials provided on the platform.

  2. Use of the Platform: Users acknowledge and agree that their use of MadeBy Shops is at their own risk. The platform and its owners, affiliates, employees, agents, and partners shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use of or inability to use the platform.

  3. Third-Party Content: MadeBy Shops may contain links to third-party websites, products, or services.   4. No Warranty: MadeBy Shops is provided on an "as is" and "as available" basis without any warranties of any kind, whether express or implied. We do not warrant that the platform will meet users' requirements, be uninterrupted, timely, secure, or error-free, or that any defects or errors will be corrected.

Limitation of Liability: To the fullest extent permitted by law, in no event shall MadeBy Shops or its owners, affiliates, employees, agents, or partners be liable for any damages, including but not limited to direct, indirect, incidental, consequential, or punitive damages, arising from the use of or inability to use the platform.

Indemnification: Users agree to indemnify and hold harmless MadeBy Shops and its owners, affiliates, employees, agents, and partners from any claims, damages, liabilities, costs, or expenses (including attorneys' fees) arising out of or related to their use of the platform, violation of the Terms of Service, or infringement of any rights of a third party.

 

Termination of Services:

  1. Grounds for Termination: MadeBy Shops reserves the right to terminate or suspend user accounts and access to the platform at any time, for any reason, and without prior notice. Grounds for termination may include, but are not limited to, violation of the Terms of Service, fraudulent activity, or legal requirements.

  2. Notice of Termination: In the event of termination or suspension of a user account, MadeBy Shops will make reasonable efforts to notify the affected user via email or through the platform's messaging system. However, MadeBy Shops is not obligated to provide prior notice or explanation for the termination or suspension.

  3. Appeals Process: Users who believe their account has been terminated or suspended unfairly may submit an appeal to MadeBy Shops. Appeals should be submitted in writing to admin@madebyshops.com, clearly stating the reasons for the appeal and any relevant evidence or information.

  4. Effect of Termination: Upon termination or suspension of a user account, the user's access to the platform and associated services will be immediately revoked. Any outstanding orders or transactions may be canceled, and any fees or payments owed to MadeBy Shops may become immediately due and payable.

  5. No Refunds: Users whose accounts are terminated or suspended are not entitled to any refunds for fees or payments made to MadeBy Shops. All fees and payments are non-refundable, regardless of the reason for termination or suspension.

  6. Survival of Terms: The termination or suspension of a user account does not affect the validity or enforceability of any provisions of the Terms of Service that are intended to survive termination, including but not limited to indemnification, disclaimers of liability, and dispute resolution.

 

Changes to the Terms of Service:

MadeBy Shops reserves the right to update, modify, or revise these Terms of Service at any time, without prior notice. Any changes to the Terms of Service will be effective immediately upon posting the revised terms on the platform. Continued use of the platform following the posting of updated Terms of Service constitutes acceptance of the revised terms by users.
